With articles 7 and 8 of Law 4931 of 2022, provisions are added regarding the process of controlling expenses to detect and prevent illegal behavior of the providers of the E.O.P.Y.Y., which provide for the possibility of due to an audit, carried out in real time, to be reduced to the total of the submitted expenditure of each provider and to be assigned to natural or legal persons of public or private law.

Furthermore, it is possible to define categories of providers and categories of benefits for control, which may cover the whole of the submitted expenditure. The control in this case is carried out either in real time with on-site visits to the providers and remotely using new technologies, or afterwards by checking the supporting documents and using new technologies and
statistical methodology, and in any case before the payment of the expenses, either by the competent services of the EOPYY or by natural or legal persons of public or private law, who are specialized in such checks, in accordance with the applicable provisions and instructions of the E.O.P.Y.Y. regarding the reimbursement of expenses provided for in the E.K.P.Y. and the contractual obligations of the providers.

However, the rationalization of public expenditure cannot be determined by legislation, until new relevant data become available.

Therefore, the proposal is assessed as being implemented.
