With the provisions of Law 4843/2021 in part E, necessary regulations are foreseen to strengthen competition in the electricity market in application of the commitments of the Hellenic Republic from September 1, 2021, in the context of case COMP/AT.38700 and in compliance with the decisions C(2008) 824 and C(2009) 6244 of the European Commission, which became irrevocable after the (2016) 733 and (2016) 748 decisions of the General Court of the European Union.

The arrangements concern the operation of the Greek electricity market, in accordance with the EU legislative framework for the organization and operation of the markets and the participants and the Operators of the electricity markets, PPC SA and GE.MH., in terms of the merger process as a measure lifting the separation of branches from PPC, in 2018, and the establishment of the companies "LIGNITIKI MEGALOPOLIS MONOPROSSOPI S.A." and "LIGNITIKI MELITIS MONOPROSOPI S.A."

The resolution of issues related to the fulfillment of the commitments of September 1, 2021 of the Hellenic Republic to the European Commission is sought. Regarding the removal of the divestment, the return to the previous situation through the granting of the possibility of merger, depending on the intended business strategy of PPC S.A., since the measure in question is no longer relevant under the new commitments. The financial freedom of PPC S.A. is restored.

Therefore, the proposal is assessed as implemented.
